‍1. Liability Waiver and Release of Claims

Applies to: The OsteoCollective, LLC (including Trubee Training and Dr. Nick Trubee), Functional Foods LLC, and Ashlee Williams, RD

‍Acknowledgment and Assumption of Risk

‍By enrolling in or participating in any exercise, fitness, educational, coaching, or community program offered by The OsteoCollective, LLC (the “Company”)—including but not limited to the OsteoFit Program, group training sessions, and virtual community activities (collectively, the “Programs”)—I acknowledge that participation involves inherent risks.
These risks may include muscle strain, joint or bone injury, falls, cardiovascular events, or other physical or psychological harm. I understand that improper form, preexisting conditions, or environmental factors may increase the likelihood of injury.

I voluntarily assume all such risks and acknowledge that The OsteoCollective, LLC, Trubee Training, and Dr. Nick Trubee (collectively, the “Released Parties”) are not responsible for determining my medical readiness to participate. I confirm that I have consulted, or will consult, with my own healthcare provider before engaging in these activities.

‍No Medical Advice or Doctor–Patient Relationship

‍The Programs and all related content are for educational and informational purposes only. Participation does not create a doctor–patient relationship with any Released Party. The Programs are not a substitute for medical evaluation, diagnosis, or treatment. I am solely responsible for obtaining professional medical advice as needed.

‍Release of Liability

‍In exchange for participation, I hereby release and hold harmless the Released Parties—including their owners, officers, employees, contractors, affiliates, and agents—from any and all claims, damages, or expenses arising from injury, illness, or loss related to participation in the Programs. This release includes claims based on negligence, instruction, or equipment use, whether foreseeable or not.

‍Virtual Participation and Environmental Responsibility

‍I acknowledge that all Programs are conducted virtually and that I am responsible for ensuring a safe space for participation, including adequate room, secure equipment, and hazard-free surroundings. The Released Parties are not responsible for injuries resulting from unsafe environments or equipment misuse.

‍Recording, Use, and Redistribution of Sessions

‍I acknowledge that virtual group activities—such as OsteoFit workouts, group coaching, workshops, and community sessions—may be recorded and used for educational or promotional purposes by The OsteoCollective, LLC. By participating, I grant permission for my image, voice, name, and statements to be used without notice or compensation. If I do not wish to appear in recordings, I am responsible for turning off my camera and microphone.

‍Community Privacy and HIPAA Disclaimer

‍The OsteoCollective, LLC operates in an educational and community-based environment that is not HIPAA-compliant. I understand that information shared in live or recorded sessions may be visible to others. By participating, I accept responsibility for the information I share and agree not to disclose sensitive medical details that I wish to remain private.

‍Assumption of Responsibility

‍I understand and agree that: I am solely responsible for my participation and decisions. I will use my judgment, listen to my body, and stop any activity that causes discomfort or pain. I assume all risks associated with virtual and physical participation.


‍Severability

‍If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall remain in effect.

‍Governing Law and Venue

‍This Agreement is governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. All disputes shall be resolved in a court of competent jurisdiction in North Carolina.


‍Electronic Acknowledgment and Signature

‍By checking a box, clicking “I Agree,” or registering for any Program, I confirm that I have read, understood, and agree to this Liability Waiver and Release of Claims. This electronic acknowledgment is legally equivalent to a handwritten signature.


‍Acknowledgment of Understanding

‍I confirm that I have read this agreement carefully, understand its terms, and voluntarily accept them. I understand that I am waiving substantial legal rights, including the right to sue the Released Parties for negligence.


‍2. Payments & Refunds

‍All purchases, subscriptions, and services are final and non-refundable. By using our services, you agree not to dispute or charge back any transactions. If you cancel your membership or subscription, you will retain access until the end of your billing period—no partial or prorated refunds are issued.


‍3. Cancellation Policy

‍You may cancel your subscription at any time by updating your account settings or contacting support@osteocollective.com. Cancellation prevents future billing but does not provide refunds for previous charges.


‍4. Use at Your Own Risk

‍All services and recommendations are provided “as is” and used at your own risk. Results vary and are not guaranteed. The Company is not liable for any outcomes or consequences of participation or use of information provided.


5. Community Guidelines

‍Members must maintain respectful, appropriate communication at all times. Harassment, hate speech, solicitation, or disruptive behavior will not be tolerated and may result in immediate removal without refund.


‍6. Opt-In to Email Marketing

‍By using our services, you consent to receive promotional emails, updates, and communications. You may unsubscribe at any time by clicking “unsubscribe” in any email.


‍7. Educational Resources

‍Members are encouraged to review tutorial materials, follow provided instructions, and participate in community education sessions to ensure a safe and effective experience.
